Generative AI models can help you explore new topics, inspire your creativity and learn new things. However, we expect you to use and engage with them in a responsible, legal manner.
These Self-Serve AI Service-Specific Terms (“SSTs”) apply if you are using and accessing a SurveyManager Service incorporating the “Create a Survey using AI” (SurveyManager AI as defined below) feature.
“SurveyManager AI” means any generative AI feature(s) or functionality made available by SurveyManager. SurveyManager AI is a feature that uses the Open AI ChatGPT Service - Terms of use | OpenAI.
1. Input and Output
You may provide input to be processed by SurveyManager AI (“Input”), and receive output generated and returned by SurveyManager AI based on the Input (“Output”). When you use SurveyManager AI, Input and Output are your Content. You are solely responsible for the development, content, operation, maintenance, and use of your Content. You agree that your Input and use of SurveyManager AI and Output will not (i) violate any applicable law; (ii) violate these SSTs, the TOU or Acceptable Use Policy - Terms of Use » Survey Manager ; or (iii) infringe, violate, or misappropriate any of SurveyManager's rights or the rights of any third party. You agree that you will not input any confidential or sensitive information, including but not limited to protected health information. You acknowledge that due to the nature of machine learning and the technology powering SurveyManager AI, Output may not be unique and SurveyManager AI may generate the same or similar output for SurveyManager or a third party. Responses or results that are requested by and generated for other users are not considered your Content.
2. Accuracy
Given the rapidly evolving nature of artificial intelligence and machine learning, you acknowledge that use of SurveyManager AI may sometimes result in incorrect Output that does not accurately reflect real people, places, facts, or data. You agree to evaluate the accuracy of any Output as appropriate for your use case, including by using human review of the Output. You agree that you will not rely on SurveyManager AI for legal, medical, financial, or other professional advice.
3. Improving SurveyManager AI
Artificial intelligence and machine learning models can improve over time to better address specific use cases. You agree that we or Open AI may use Content from SurveyManager AI or from your use of SurveyManager AI to improve SurveyManager AI and the Services and as permitted by the SurveyManager privacy notices. In some cases, we have controls in your account settings where you can opt-out or turn off the feature; you are responsible for choosing the appropriate setting. In other cases, artificial intelligence and machine learning models operate automatically upon use of a specific feature or service which is fundamental to SurveyManager's overall services. You acknowledge that if you choose to opt-out, this may limit the ability of SurveyManager AI to address your specific use case.
4. SurveyManager AI Feature Use Restrictions
You agree that you will not use SurveyManager AI or Output (i) to develop any models, including foundation models or other large scale models, that compete with SurveyManager or SurveyManager AI; (ii) to reverse assemble, reverse compile, decompile, translate or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of SurveyManager AI, including exfiltrating the weights of models; (iii) to mislead any person or represent that Output from SurveyManager AI or the Services was solely human generated; (iv) to generate spam or content for dissemination in electoral campaigns or lobbying, including targeting at specific demographics; or (v) in a manner that violates any technical documentation, usage guidelines, or parameters referenced herein or otherwise provided in connection with SurveyManager AI. You agree that you will not use web scraping, web harvesting, or web data extraction methods to extract data from SurveyManager AI or from the Output. You agree that you will use SurveyManager AI only in geographies currently supported by OpenAI.
You acknowledge and agree that your use of SurveyManager AI is subject to usage limit restrictions. If you exceed the usage permitted, you will not be able to access the feature until the restriction has cleared, and SurveyManager may disable or degrade performance of such SurveyManager AI feature(s).
SurveyManager may, in its sole discretion, block or disable your access to, or suspend or terminate your use of, SurveyManager AI and/or the Services, in the event of any violation or reasonably suspected violation of these SSTs.
5. Third Party Provider Policies
You agree that you will not use SurveyManager AI feature(s) in a manner that violates any OpenAI Policy, including their Usage Policies and Sharing and Publication Policy, or any other third party provider policy or as otherwise provided in connection with SurveyManager AI.
6. WARRANTY DISCLAIMER
SURVEYMANAGER AI IS PROVIDED AS-IS. SURVEYMANAGER AND ITS LICENSORS DO NOT MAKE ANY WARRANTY (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF SURVEYMANAGER AI OR THE ACCURACY OF ANY OTHER INFORMATION OBTAINED THROUGH SURVEYMANAGER AI. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA OBTAINED THROUGH THE USE OF ANY SURVEYMANAGER AI FEATURE IS DONE AT YOUR SOLE RISK. YOU SHOULD NOT RELY ON FACTUAL ASSERTIONS IN OUTPUT WITHOUT INDEPENDENTLY FACT CHECKING THEIR ACCURACY. OUTPUT THAT APPEARS ACCURATE BECAUSE OF THEIR DETAIL OF SPECIFICITY MAY STILL CONTAIN MATERIAL INACCURACIES. SURVEYMANAGER AI CANNOT DYNAMICALLY RETRIEVE INFORMATION, AND OUTPUT MAY NOT ACCOUNT FOR EVENTS OR CHANGES TO UNDERLYING FACTS OCCURRING AFTER THE AI MODEL WAS TRAINED. NO INFORMATION OR ADVICE, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SURVEYMANAGER OR THROUGH SURVEYMANAGER AI SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
7. Service Level Terms Are Not Applicable
Notwithstanding anything to the contrary in the TOU, downtime of SurveyManager AI that results from a failure of a third party service will not be included in any availability or uptime calculations.
8. Collaboration
If you are invited to join or are part of a SurveyManager Teams or Enterprise account, you acknowledge and agree that the administrator or primary administrator of such account is solely responsible for implementing and managing SurveyManager AI settings for all Content, including your Content.
